CODE OF CONDUCT

Thank you for your patronage today. Colony Square Mall, including the parking areas, is private property. In order to provide a safe, secure and comfortable environment, Colony Square Mall asks all center visitors, patrons, tenants and employees to comply with the following rules.
The following activities are prohibited on the Mall property at all times:

1. CRIMINAL ACTIVITY: Any act which constitutes a crime or criminal conduct under a statute or ordinance. Any activity that would constitute a violation of local, state of federal law or that would give rise to personal liability.

2. WEAPONS: Carrying or displaying a weapon of any kind, whether or not by permit, except those carried by certified Federal, State and Local law enforcement officers in the performance of their duties. Possession of any item that could be used as weapon is prohibited, including but limited to: firearms, explosives, fireworks, clubs or sticks over ¼ inch in diameter, chemical dispensing devices, knives with blades over 2 inches in length, or any other objects that may be used in any way to inflict bodily injury.

3. ALCOHOL AND NARCOTICS: Possessing open cans, bottles, or other receptacles containing any alcoholic beverage, except in businesses licensed to serve alcoholic beverages, possessing or using illegal substances.

4. SMOKING: Smoking is prohibited in the Center, including electronic/vapor cigarettes.

5. LOITERING: Loitering, blocking storefronts, fire exits, etc. Congregating in groups in such a way as to cause inconvenience to others. Using the center as a place of slumber or temporary residence.

6. IMPROPER ATTIRE: Failing to be fully clothed (including wearing pants in a manner that expose undergarments) or wearing attire which is considered inappropriate and/or offensive per the sole judgment of Mall Management or its authorized representatives. Wearing apparel which is likely to provoke a disturbance or embroil other groups or the general public in open conflict or is otherwise inappropriate in a shopping environment (such as clothing with obscenities, “fighting words,” gang symbols, drug paraphernalia, explicit language or photos, grisly or gruesome material). Excluding attire worn in accordance to religious practice or tradition, or for medical reasons.

7. SOLICITATION/COMMERCIAL ACTIVITY: Soliciting money or other contributions or donations, engaging in commercial activity or distributing literature, advertising materials are prohibited. Demonstrations, and special promotions or using the property for any purpose other than shopping is prohibited, without prior written permission of Mall Management.

8. PHYSICAL CONDUCT: Physically threatening any person, fighting, hitting, spitting, photographing or videotaping in an aggressive or intimidating manner, annoying others through noisy or boisterous activities, unnecessarily staring in an intimidating or lewd manner, stalking, throwing of any objects, or in any other way creating a disturbance which is disruptive or dangerous to others or the business activities of the Center.

9. VERBAL CONDUCT: Verbally threatening or harassing a person, using obscenities, or using sexually explicit language, obscene gestures or racial, religious or ethnic slurs which are likely to create a disturbance or infringe on the rights or peace of other patrons of the Center.

10. DISTURBING THE PEACE: Assembling for the purpose of disturbing the public peace or committing any unlawful act. Yelling, “hawking,” screaming, singing, playing of musical instruments, radios, use of any device or instrument or equipment for the reproduction or amplification of sound or otherwise creating noise that impinges on the hearing or peace of the Center’s patrons beyond a ten (10) foot radius. The use of a generator is also prohibited.

11. EXPRESSIVE ACTIVITY: Any disturbing of the peace, including, but not limited to, unlawful or non-permitted assembling, demonstrating, parading, picketing, marching, flash mobs, or any other activity that hinders or prevents the shopping enjoyment of customers or disrupts the intended business use of the shopping center. No political campaigning is permitted on Colony Square Mall property or anywhere on the shopping center campus. This includes, but is not limited to, campaign signage, campaign events, and any other campaign-related promotions.
12. SAFETY/IMPEDING THE FLOW OF TRAFFIC: Running, wrestling, horseplay, skipping, skating, rollerblading, skateboarding, bicycling, riding Razors, hover boards, using a scooter or Segway (except if needed due to a disability), or otherwise obstructing or interfering with the free flow of pedestrian traffic or with patrons’ views of windows or displays.

13. GRAFFITI/VANDALISM/TRASH: Defacing, damaging, or destroying property in any area belonging to the Center, its patrons or tenants, including writing, spraying, scratching or affixing decals, signs or other graffiti on such property. Throwing or discarding any paper, glass or other matter of any kind except in designated trash and recycling receptacles. Removing items from any trash or recycling receptacles.

14. ANIMALS: All animals, other than Service Animals, are prohibited, except where otherwise specifically permitted, such as for special events. Pursuant to the United States Department of Justice guidelines, only dogs that are individually trained to do work or perform tasks for people with disabilities qualify as service animals.

15. PHOTOGRAPHY/RECORDING: Photography or recordings of any kind without prior approval of shopping center management are prohibited.

16. INTERNET/MUSICAL DEVICES: Viewing or displaying material on laptops, tablet computers, smartphones, etc. that is likely to provoke a disturbance or embroil the Center’s patrons in conflict, uses obscenities, “fighting words,” sexually explicit language, or images displaying the aforementioned content, or displays of pornography, grisly or gruesome material. Excessive use of the Center’s Wi-Fi system is also prohibited. The playing of radios, musical instruments or similar devices, except as approved by Mall Management.

17. PARKING LOT: Driving in an unsafe, erratic, or careless manner, including, but not limited to exceeding the posted speed limit or using a vehicle in a manner prohibited by traffic markings, signage, or otherwise obstructing traffic. Overnight parking, parking in non-designated parking areas, parking in fire lanes or other no parking areas. Parking violators may be subject to towing at the vehicle owner’s expense.

18. TRESPASSING.

This list is not all inclusive and may be modified at any time by the management of this shopping center.
Violation of this code of conduct may result in expulsion from this property in addition to any other legal remedies that shopping center management may choose to exercise.
This shopping center is private property, and no rights shall accrue to the public by virtue of the public’s entry into this shopping center or on shopping center property. This “Code of Conduct” is not intended to deprive any person of their applicable civil rights or liberties under the law. If you feel your rights are being violated, please notify the shopping center management office.
